OBJECTIVES
• PURPOSE OF THE GIR:

The group of researchers whose acknowledgment of application originates from the Consolidated Research Unit (UIC120) recognized by resolution of the Junta de Castilla y León of January 29, 2015. It has addressed, and intends to continue to do so, the critical analysis of the two paths followed for the consolidation of the European Justice Area, through the study of existing regulatory instruments and their application in the process, from national and European points of view, as well as through the preparation of proposals for reform or new rules regarding procedural guarantees. Two paths, which are not antagonistic but complementary, and which have finally converged: the mutual recognition of judicial decisions and the approximation of national legislation.
The current integration situation requires greater vigilance on the actions of the national and European public powers in order to control the respect for the guarantees of citizens, particularly when they demand justice in the process.

The ordinary members of the group are currently part of the GIR Legal protection of the family since its inception; However, having started years ago a new line of specific research that departs from that, recognized as UIC by the JCyL and that has obtained a research project in the call of the 2016 MINECO Challenges and Excellence, they request the recognition of this new GIR, leaving then and consequently the previous one.


MAIN OBJECTIVES OF THE GIR:

a) Scientific publications in indexed journals.
b) Participation in Congresses, Seminars and meetings of experts
c) Direction of doctoral theses
d) Collaborations with other groups of the Grape and other national and foreign universities.
e) Transfer of knowledge to various sectors:
o Opinions via art. 83 LOU
o Specialization courses
o Technical-legal reports
o Collaboration agreements or agreements with companies and public and private organizations
o Contracts with companies and public sector organizations (arts. 83 LOU)

RESEARCH LINES

- Procedural guarantees in criminal proceedings from the point of view of the investigated and accused.
- Guaranteed principles of substantive criminal law.
- Guarantees in the adoption and validity of precautionary measures.
- Effects of the harmonization of procedural guarantees on the mutual recognition of criminal decisions within the European Union.
- “Dialogue of courts” through national case law, the CJEU, the ECtHR and other supranational courts, on the effective enforcement of the main procedural guarantees.
- Due process as a guarantee of the litigants in national and European Union law.
